We continue to get inquiries regarding the recent EPA lead regulations for contractors working on buildings built prior to 1978. Stiff penalties have been levied by the EPA. We don’t want to take advantage of the new EPA regulations to sell an insurance policy that isn’t going to guard against the EPA fines for failure to get the required training.
If you’re concerned about large EPA fines, you should make sure all your employees have received the lead training that is required. Getting fined for failure to comply with the training requirements will not constitute an occurrence on a pollution policy or a CGL policy, so it makes it a poor reason to buy pollution coverage.
